5) Psychological damage is still damage. It’s not just physical. It’s the way you think, talk, knee jerk reactions, favoritism. Things that are more subtle- that can’t be managed by law enforcement without some type of illicit thought control. And that would eliminate free will.
6) It wouldn’t matter if it did or not. Even if two ponies were identical in every capacity they’d find something.
